These Terms of Service ("Terms") govern your access to and use of the website wololoom.com and any related services (the "Service"), operated by Datatamer LLC, a Delaware limited liability company with its registered office at 16192 Coastal Highway, Lewes, Delaware 19958, USA ("Datatamer", "Wololoom", "we", "us", or "our").
By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
/02
Eligibility
You may use the Service only if you are at least 16 years old and able to enter into a legally binding contract under the laws of your country of residence. By using the Service, you represent that you meet these requirements.
If you are using the Service on behalf of a company or other legal entity, you represent that you are authorised to bind that entity to these Terms, and "you" refers to both you personally and that entity.
/03
Your account
To access certain features of the Service, you must create an account. You can create an account with an email and password, or by signing in with a supported third-party identity provider (such as Google or Facebook).
- —You must provide accurate and current information when creating your account, and keep that information up to date.
- —You are responsible for maintaining the confidentiality of your credentials and for any activity that occurs under your account.
- —You must notify us promptly at [email protected] if you suspect any unauthorised access to your account.
- —You may not share your account, sell it, or transfer it to another person without our written consent.
/04
Licence to use the Service
Subject to your compliance with these Terms, Datatamer grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal business use.
All rights not expressly granted to you in these Terms are reserved by Datatamer and its licensors. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from the Service or any part of it, except as expressly permitted by these Terms or by applicable law.
/05
Your content
You may submit content to the Service, including but not limited to design files, sketches, photographs, descriptions, biographies, and other materials related to contest applications or your profile ("Your Content"). You retain all intellectual-property rights in Your Content.
By submitting Your Content, you grant Datatamer a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, reproduce, display, transmit, and distribute Your Content solely as needed to operate, provide, promote, and improve the Service. This licence ends when you remove Your Content from the Service or close your account, except (a) for backups retained for a reasonable period before deletion, and (b) where Your Content has been shared with other users or shown publicly in a way that cannot reasonably be undone.
You represent and warrant that you own or have all necessary rights to submit Your Content and to grant the licence above, and that Your Content does not infringe the rights of any third party.
/06
Contests and open calls
From time to time we may run design contests or open calls (such as the Founding Designers Open Call). Specific eligibility, deadlines, judging criteria, prizes, and rights granted to Wololoom in connection with any contest entry will be set out in the contest's published rules or guidelines, which form part of these Terms when you participate.
Where contest rules and these Terms conflict, the contest rules govern with respect to that contest only.
/07
Acceptable use
You agree not to do, or attempt to do, any of the following while using the Service:
- —Use the Service in any way that violates applicable law or regulation, or that infringes the rights of any third party (including intellectual-property and privacy rights).
- —Submit content that is unlawful, defamatory, harassing, hateful, obscene, fraudulent, or that promotes violence or discrimination.
- —Upload or transmit any virus, worm, malware, or other harmful code, or otherwise interfere with the operation, security, or integrity of the Service.
- —Attempt to gain unauthorised access to the Service, other users' accounts, or any underlying systems or networks.
- —Use the Service to send unsolicited commercial messages, scrape or harvest data, or impersonate any person or entity.
- —Reverse-engineer, decompile, or attempt to extract the source code or underlying ideas of the Service, except where this is permitted by law.
We may suspend or terminate accounts that breach this section, with or without notice.
/08
Third-party services
The Service relies on, and may interact with, third-party services such as Google (for sign-in), Meta (for sign-in via Facebook), Resend (for email delivery), and Cloudflare (for DNS, TLS, and DDoS protection). Your use of those services is subject to their own terms and privacy policies, and we are not responsible for their content, availability, or practices.
/09
Termination
You may stop using the Service and delete your account at any time, by following the instructions on our Data Deletion page or by emailing [email protected].
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe that you have breached these Terms, that your account is being used fraudulently, or that continued access creates a legal or security risk for us or other users. We may also discontinue all or part of the Service at any time, in which case we will use commercially reasonable efforts to give you advance notice.
Sections that by their nature should survive termination (including those on Your Content, disclaimers, limitation of liability, indemnification, and governing law) will survive.
/10
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the exclusions in this section may not apply to you. In that case, the excluded warranties apply only to the minimum extent required by applicable law.
/11
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DATATAMER, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud).
/12
Indemnification
You agree to indemnify and hold harmless Datatamer, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) Your Content; or (c) your breach of these Terms or violation of any law or third-party right.
/13
Governing law and disputes
These Terms and any dispute arising out of or in connection with them or with the Service are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Subject to applicable mandatory consumer-protection law, the state and federal courts located in Delaware have exclusive jurisdiction over any such dispute.
If you are a consumer resident in the European Economic Area or the United Kingdom, this section does not deprive you of the protection of mandatory provisions of the law of the country where you live, and you may also bring proceedings in the courts of that country.
/14
Changes to these terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will notify you by email or through a prominent notice on the Service before they take effect. Your continued use of the Service after the changes take effect means you accept the updated Terms.
/15
Miscellaneous
These Terms, together with our Privacy Policy and any contest rules or other documents we expressly incorporate by reference, are the entire agreement between you and Datatamer regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms freely.
